Can you flash your gun in self defense?
I live in missouri and am about to get my conceal carry license. My question is if I encounter an individual that is showing hostile intent and i have no means of escape can show that i have a gun on me (still holstered of course) as a deterrent? OR What is the best method of preventing the situation from escalating, short of drawing my weapon?
Shooting a person is always a last resort.
This is a very complicated question and it depends on manner of carry, distance, weapons in the hands of your attacker, and disparage of force. You may want to draw your weapon! You stated you believe there is hostile intent, and you have no means of escape. So fleeing (always a better option) is not available.
If your attacker is less than 21 feet away has a weapon (knife, club...) is bigger than you, and you believe that an attack is imminent - Draw, out of the holster, point the gun at the attacker and keep your finger off the trigger. Do not put our finger on the trigger until you make the decision to shoot after all other options have been exhausted - shooting a person is always a last resort.
IF the attacker is smaller, further away or does not have a weapon then your ability to draw diminishes with each point you take away from the scenario. But if you feel you are in danger of death or great bodily harm - draw.
IF the attacker is simply a noisy jerk (no hostile intent... yet) then absolutely do not draw, simply appologize mention that you don't want any trouble, lets all go home without any issues, don't make eye contact... If the attacker escalates the situation to a point where you feel threatened for you life or great bodily harm - draw, and follow the rules above.
No matter what call the police - you don't want to make the mistake of drawing on a person and not calling the police - someone may have seen and already called. If the police show up and you admit to drawing/flashing and you haven't called you will have some major explaining to do.
